General
The user agrees to be bound by these General Terms of Service when registering to or using Tibidiscis service ("Service"). The current Terms of Service are available on the web site of the Service. A registered user can also find the Terms of Service on the page 'My Subscription'.
A non-registered guest user agrees to be bound by these General Terms of Service as applicable.
The Service may include additional components or services, for which special terms apply. Those terms are defined outside of these General Terms of Service.

Content of the Service
Service is divided into a free service and a paid service. Moreover, the free service is divided into use as a registered user and into use as a non-registered guest user.
In the Service, some languages are fee-based, some languages are free.
The paid service includes all languages available in the Service. The user can add new content for one's own use and modify the existing content. Learning statistics are stored for monitoring progress. It is possible that later some additional components are added to the Service that are only accessible with an extra fee.
A subscription for a paid service is a fixed-term subscription. The subscription does not continue automatically, but the user has to renew the subscription. If the user does not want to renew the subscription, the service continues like with the free service, that is, the user can learn the fee-based languages using the content provided by the Service, and free languages like a registered user.
The personal account data, the content added by the user, and the learning statistics are stored for six (6) months after the end of the subscription. If the user continues with the free usage, the user data are stored until six (6) months after the last sign-in. During this time, the user can reactivate the subscription by renewing it and continue to use the Service with the previously stored data included.
The free service includes learning free languages, such that new content can be added and existing content modified. Learning statistics are stored. A registered user can also learn fee-based languages using the content provided by the Service. New content cannot be added for these languages, but the learning statistics are stored. The learning statistics are stored until six (6) months after the last sign-in.
A guest user can learn all languages using the content provided by the Service. Learning results are not stored after the session expires.
Tibidiscis Ltd ("Service provider") has the right to modify the contents of the Service and to close the Service or a part of it. The users are informed about the changes on the website of the Service.

Registration to the Service
The user signs up for the Service by entering a name, an email address and a password. The email address operates as a user ID and it has to be a valid email address under the control of the user. After sign-up the Service sends an email with a confirmation link. The user confirms the email address, and thus the user account, by using the link. After confirmation the user has to sign in, in order to receive the service that is offered to the registered users.
The Service can offer other authentication credentials than email and password.
The right to use the Service is granted for a personal use. The user may not assign or transfer its rights or obligations under these terms (including a password and other authentication credentials) to a third party.
The Service provider may refuse to open an account or terminate an account, if the user violates any laws, regulations, or these Terms of Service, or uses the Service in a manner that is unacceptable or offensive. The Service provider may also temporarily suspend the Service if it is necessary for the operation of the Service.

Subscribing for paid service
Users under 18 years may subscribe for a paid service only with their parents' consent.
When a registered user, who wants to subscribe for a paid service, has confirmed the email address and signed in to the Service, the user will be taken to a subscription page, where the user can give the term of the subscription. The term can be from 1 to 12 cycles. One cycle is 30 days. The price list can be seen on the website of the Service.
The subscription is paid in advance, in the beginning of the term. After selecting the term, the user will be taken to a payment page. The payment services are carried out by Paytrail Oyj (Business ID: FI21228397).
The following payment options are available:
- Finnish netbanking: Nordea, Osuuspankki, Sampo, Tapiola, Aktia, Nooa, Paikallisosuuspankit, Säästöpankit, Handelsbanken, S-Pankki, Ålandsbanken
- Credit and debit cards: Visa, Visa Electron and MasterCard
- Paytrail Account (Visa, MasterCard, Maestro SecureCode, Diners Club, JCB)
Netbanks: Paytrail Oyj (FI21228397) provides netbank related payment transfer services in co-operation with Finnish banks and credit institutions. For consumer the service works exactly the same way as traditional web payments.
Payments with Visa, Visa Electron or MasterCard: Paytrail Oyj (FI21228397) acts as an implementer of the payment handling service and as a Payment Service Provider in cooperation with Finnish banks and credit institutions. In payments made with Visa, Visa Electron or MasterCard Paytrail Oyj will be shown as the recipient in the invoice and Paytrail Oyj will forward the payment to Tibidiscis Ltd. Paytrail Oyj is an authorized Payment Institution.

Cancelling
A fixed-term subscription is valid until the end of the term, and it cannot be cancelled during this period.
After the payment of the first term, the user has 14 days in which to cancel the subscription, unless the user starts using the Service. If the user starts using the Service, the right of withdrawal expires (Customer Protection Act, Chapter 6, Section 16). The system will ask the user at sign-in, whether the user wants to start using the Service. In order to cancel, the user has to send an email to the customer service (support@tibidiscis.eu).
The user can put the subscription on hold for a later use (for 6 months at most). When the user puts a subscription on hold, the subscription will continue to run normally until the end of the current cycle. The subscription is on hold starting from the beginning of the next cycle. The user can restore the subscription anytime. The subscription is reactivated automatically after six months, if not restored by the user before that.

Responsibility of the Service provider
The Service is available twenty-four hours a day, seven days a week, but interruptions are possible due to maintenance and updates. The Service may also be interrupted, if it is suspected to be a target of an attack or for other security reasons or to maintain service integrity. The users are informed of the interruptions on the website of the Service, if possible.
The Service and all the content is provided on an "as is" basis and without warranty of any kind. To the extent that applicable law permits, the Service provider accepts no liability for any direct, indirect, consequential or incidental damages or losses arising from use of the Service, or from the unavailability of the Service, for whatever reason. The Service provider does not guarantee fitness for any particular purpose.
The registration data, content added by the users, and the learning statistics are backed up regularly, but it is still possible that content is lost and it cannot be recovered. The liability for compensation is in any case limited to the total of fees paid by the user in the previous six (6) months.
The Service provider processes all personal data and content confidentially and does not disclose any information to a third party. Personal data can be used in an aggregated form to improve the Service. Details of the information collecting and its use can be found in the Privacy Policy.

Responsibility and liability of the user
The user is responsible for having and maintaining a suitable technical equipment, software, and Internet access for the use of the Service, at the user's own expense. We recommend the use of the newest browser versions. The Service requires that JavaScript and cookies are enabled in the browser.
The user agrees to notify the Service provider promptly of a change of the email address, on the page 'My Subscription'. If the user fails to notify of a change, then any notice the Service provider sends to the old address, for instance in case of change of terms, shall be deemed sufficient notice.
The user is responsible for all uses of the Service via the user's email address and password.
The Service cannot be included in any other service, or used or accessed by any automated process, without a written consent from the Service provider.
Using the Service in a way that disturbs the other users or the Service, or intends to harvest user information, is forbidden. The user may not try to get access to information the user does not have right to. Any usage that may lead to denial of service or otherwise interfere or interrupt the Service is forbidden.
Content provided by the Service is only for the private use of the user, unless a licence attached to the content states otherwise.
The user is liable for all the damage for Service provider or a third party, if the user uses the Service in a way that violates these General Terms of Service, legislation, order of authorities, or in a way that is unacceptable or offensive.
Although the content that the user has added to the Service can only be seen by the user, and the Service provider makes every attempt to ensure the protection of the content, no confidential material should be added to the content.
If the user is accidentally exposed to information that belongs to other users or the Service provider, usage, storage, and distribution of this information is forbidden. The user has to notify the customer service (support@tibidiscis.eu) of any such incident.

Force majeure
The Service provider is not liable for any loss or damage caused by an interruption of the service and other operations, if such failure is as a result of an event beyond the control of Service provider, such as discontinuation of Internet service or electricity supply, regulation or order of authorities, strike, fire, or other unforeseeable circumstances against which it would have been unreasonable for Service provider to take precautions.
The Service provider notifies the users of an event of Force Majeure immediately after its occurrence on the website of Service, if this is possible.

Changes to the Terms and Service
We reserve the right to modify the Service, pricing, and Terms of Service. The registered users will be notified of the changes by email and on the web site of the Service at least thirty (30) days in advance. The time to notify can be shorter, if the modification is due to a change in legislation, a decision by the authorities, or a security threat.
If the change only adds content or improves the Service, or if the change is insignificant to the user, the notification is only posted on the website of the Service as the change becomes available.

Duration of the contract
If the user wants to remove all the personal information, before it is removed automatically after expiration, they can send an email to the customer service (support@tibidiscis.eu). The website of the Service may offer other possibilities to cancel the service, as well.
A breach of the Terms of Service will lead to immediate suspension or termination of the service. All fees paid are nonrefundable.

Disputes and applicable law
If a dispute concerning a sales contract cannot be resolved through negotiation between the parties, the consumer can submit the matter to the Consumer Disputes Board (www.kuluttajariita.fi/en) for resolution.
Before taking the matter to the Consumer Disputes Board, the consumer should contact the Local Register Offices' Consumer Advisory Service (www.kuluttajaneuvonta.fi).
The European Commission has opened an online dispute resolution platform (so called ODR forum) for consumers and businesses. It is accessible under http://ec.europa.eu/odr.
Any disputes arising from this contract and these Terms of Service shall be governed by the laws of Finland.
These terms are effective as of 15 February 2016.
